What it asks

The questions underwriters ask, in plain English.

Each one comes with a line saying why it's asked, so your client answers fully the first time.

  1. 1Which services does the agency provide? Tick all that apply. Each service carries a different risk. TV advertising, promotions and list broking cost the most to insure.
  2. 2Is all content reviewed by a lawyer, in-house or external, before it is published?Pre-publication legal review is the control media insurers value most.
  3. 3Is there a set process to make sure your work does not infringe anyone's intellectual property, and that every licence or permission is obtained for third-party images, music, footage, fonts and text?Using an image or a piece of music without the right licence is one of the most common claims against agencies.
  4. 4Do clients always approve the final content, proofs and artwork before they are printed, published or go live?Client sign-off is the best defence when a client later says the work was wrong.
  5. 5Do you run websites, social media pages or other platforms where the public can post content, such as comments, reviews or uploads? You can be liable for what other people post on platforms you run.
  6. 6Do you use AI tools, including generative AI, to create content or do work for clients? Some AI tools don't give you the rights to use what they produce commercially, and their output can copy others' work.
  7. 7Do you ever agree to be liable for a client's consequential losses, or for damages greater than the value of the contract?Liability you take on by contract beyond the law may not be covered.

Minimum cover

What sets the limit

We know of no regulator that sets a minimum professional indemnity limit for marketing agencies in Australia. Check any licence or membership the business holds.

Client contracts and tenders
The limit is usually set by the agency's clients: master services agreements, retainers and government or corporate tenders commonly name a minimum professional indemnity limit, and sometimes public liability and cyber limits too.

A summary, not advice. Check each client contract and tender before choosing a limit.

Before you ask

Questions about the marketing agencies fact finder.

Is the marketing agencies' fact finder really free?
Yes. Answer it on the page as your client would, and download it as a fillable PDF with your logo, with no login and no email. Sending it to a client as a link comes with a free 14-day trial.
How does it fill the insurers' forms?
Each question is linked to the same question on the media and marketing forms in the Coverbound Form Library. When your client answers the fact finder, starting an insurer's form puts their answers in, and your client confirms them instead of typing them again. The rest of each form, mostly tables of largest contracts, principals and past claims, they answer there.
Does it cover media liability as well as professional indemnity?
Yes. For agencies the two overlap: defamation, copyright and trademark infringement are the claims these forms dwell on, so the fact finder asks about legal review, clearances, releases, take-down procedures and user-generated content in detail.
Is it suitable for publishers and broadcasters?
Not on its own. It is built for agencies and content producers. Publishers, broadcasters and printers have their own sections and forms, which ask about titles, circulation, stations and presses.
Is there a minimum limit agencies must hold?
No regulator sets one in Australia. The limit is usually set by client contracts and tenders, so the fact finder asks which contract requires it.

Ask once. Fill every form.
